Foreign company’s obligations

The foreign company must:

• appoint a legal representative in France
  See the “Our Services” section for details on the representative’s obligations
• declare its employees in advance to the Employment Inspectorate using a posting declaration to be completed on-line on the official website www.sipsi.travail.gouv.fr 

Specific requirements for the building and public works (BPW) sector and Performances: 

• subscribe to an insurance fund for “paid holidays and bad weather” or a fund for “performance leave”
• request a “BPW” card for each posted worker

Specific requirements for foreign Temporary Employment Companies:

• a financial guarantee
• application of French law regarding temporary work

All the documents must be submitted in French.

In the event of an audit by the French Employment Inspectorate, the foreign company must be able to provide “without delay” some of the following documents:

• equivalent document to the French KBis
• certificate showing that all social security and tax obligations have been fulfilled
• contract between the employer and the French co-contractor
• any document demonstrating actual business activity in the country of origin
• any document certifying the Turnover in France and in the country of origin
• any other document required by the Inspectorate

and for each employee:

• identity card
• employment contract
• payslip (in accordance with the mandatory information required and shown in Euros) and any other document certifying the payment of wages
• timesheets
• copy of the appointment of the Representative in France
• medical exam
• document A1 or, failing that, the request to obtain the A1 document
• any other document required by the Inspectorate
