French Legal Representative’s obligations:
The French representative is responsible, throughout the posting period, for liaising with the employment inspectorate’s auditors (and also with the judicial police, tax authorities, customs authorities and social security bodies) and providing the authorities with specific documents which it may send either in paper format or electronically
In order to be able to respond without delay to the authorities’ checks, we notify all our clients of the need to prepare the various documents in advance, which will be stored electronically in an allocated space with secure access for 18 months following the end of the posting, as required by law
Warning: the representative cannot be held liable in the place of the employer for the employer’s obligations.
Penalties: failure to appoint a representative is punishable by a €2,000 fine per posted worker (€4,000 in the case of a repeated offence within one year) up to a total limit of €500,000.
